To Settle the Estate of William V. Moseley, Jr.

This property is  being sold As-Is, Where-Is with any & all faults, and subject to all laws, ordinances, easements, plats, titles, & any other matters of record. This real estate is being sold “ABSOLUTE” to the highest bidder. The Auction Company reserves the right to cancel the auction at any time prior to the acceptance of any bid(s).A 10% Buyer’s Premium will be added to the highest final bid and will become a part of the total contract price. The non-refundable deposit of 10% of the highest final bid, in the form of Cash or Certified funds, made payable to At Auction, Inc., is due immediately following the auction with the balance due at closing within 30 days.  Time is of the essence. Obtaining financing, if needed, is the sole responsibility of the purchaser. No owner financing is being offered. The sale is not contingent upon the purchaser obtaining financing or any other matters. All bidders & purchasers hereby waive their rights to any post sale rights of rescission periods & understand the sale is immediately binding & irrevocable.  No loan points payments, closing cost assistance, or any other purchase incentive is being offered. While all information regarding this property has been from derived sources deemed reliable and believed correct; neither the Sellers, Auction Firm, Facilitators, or their representatives; make any guarantees or warranties, expressed or implied whatsoever; regarding, without limitation; the structural integrity, physical condition, construction, extent of construction, workmanship, materials, habitability, zoning, ability to subdivide,  fitness for a particular use or purpose, topography, soil type or content, functionality of any & all systems, availability of public utilities, or merchantability of all or any part of the property. Prospective purchasers shall rely solely upon information obtained through their own due diligence. Any reliance upon the information provided shall be solely at the risk of the bidders and purchasers. The Auctioneer retains the right to determine the bid increments, &/or modify the deposit requirement. This property was built prior to 1978 and could potentially have the presence of lead-based paint. The purchaser’s lead-based paint inspection period ends on midnight prior to the auction date of sale. The Purchaser shall waive their rights to any rescission periods, lead-based paint disclosure forms or inspections, radon inspections, &/or any other home inspections; and shall accept the property As-Is. The Purchaser shall accept sole responsibility for obtaining all Property Owner’s Association disclosure information, if any; and hereby waives any rights of rescission related to obtaining such information. These terms, signed by each purchaser, and all announcements made from the auction block become part of the agreement to purchase contract.
